Experience

David is a Partner in our Employment Law Group, advising domestic and international clients across the full spectrum of contentious and non‑contentious employment law matters.

He is an experienced employment litigator and regularly represents public and private sector employers before WRC, Labour Court and civil courts, as well as in mediation. He has particular expertise in protected disclosures (whistleblowing) and employment discrimination matters and regularly advises on the avoidance or mitigation of litigation exposure in these areas in particular.

Alongside his contentious practice, David is a trusted adviser on strategic and day‑to‑day employment law issues, including working time, contractual documentation, mandatory retirement, transfers of undertakings, management of sick leave, grievances, disciplinary and dignity at work processes, and termination of employment.

Key highlights include advising:

• Science Foundation Ireland (now Taighde Éireann/Research Ireland) in relation to a series of protected disclosures, and the successful defence of an interlocutory injunction application seeking to restrain the termination of employment of its Director General.
• A Large Multinational on the conduct of a High Court application by an employee to restrain his suspension following a workplace inspection and advice in respect of that investigation.
• Dublin Airport Authority regarding the defence of an injunction application taken by a former Chief Executive Officer arising from his suspension, and advice in respect of a related employment investigation.
• A Public Body in relation to the proper management and investigation of a series of complex cross-complaints taken by a number of senior executives pursuant to Dignity at Work and Protected Disclosures Policies and related personnel issues.
• A Regulator regarding a high-profile equal pay claim before the Circuit Court.
• A University in a complaint taken unsuccessfully before the WRC and Labour Court by an employee claiming that he was penalised as a result of having made a series of protected disclosures.
