Findings and Reports Overview

The report that follows any internal investigation is an essential part of the process. It enables investigators to demonstrate that the process was both full and fair. It also sets out the findings of the investigation and so, subject to any privilege issues that may arise, can be a valuable point of reference for internal and external purposes or indeed in any subsequent regulatory inquiry.

For an external investigation, there will be an opportunity to make submissions in advance of findings being made and publication of a report.

Once any report is finalised, there will be a need for internal and external communication of the outcome of the investigation. A public relations strategy will be necessary. Remedial steps will need to be considered. If follow-on litigation is anticipated, a defence needs to be put in place.
