Financial Services

We have extensive experience advising regulated entities in the financial services area, where investigations are becoming increasingly common. In this regard, we have acted for regulated entities in many complex regulatory investigations and enforcement actions, including for example the Central Bank’s Administrative Sanctions Procedure. If you anticipate that regulatory action against your organisation may be afoot we can provide strategic advice on regulatory engagement, disclosure exercises, responding to statutory requests, legal professional privilege issues, and fair procedures in the context of any such regulatory proceedings. In addition, we have supported financial services firms in the Irish elements of multi-jurisdictional investigations involving coordinated work by multiple regulators.

Corporate

Issues frequently arise for corporates, often unexpectedly, that require immediate and decisive action and response. A board and senior executives may have systems and protocols for reacting to issues that need immediate investigation, but most do not and so it is imperative to seek advice from your trusted legal advisors. Our experienced team has experience working with many corporate organisations and other allied professional advisers to identify the critical immediate steps required as well as the strategy of the investigation and report process. Our experience extends to conducting internal investigations, investigating suspected breaches of company law and advising and representing clients in ODCE investigations and criminal prosecutions.

Operating in what is now an enhanced regulatory regime, most investigations by companies or groups address potential concerns of internal and external stakeholders, including relevant regulators wherever the business operates. We are acutely aware of these critical issues facing our corporate clients and have the requisite experience and expertise to handle all such situations with the utmost of care and attention.

 Tax

We have wide-ranging experience in all aspects of tax dispute resolution and investigation.  We take an integrated and collaborative approach to the resolution of tax issues in an efficient, technically adept and commercially astute manner.  We are uniquely qualified to advise in relation to tax disputes and investigations involving Irish taxpayers (both corporates and individuals) with the Irish, UK and other Revenue authorities.  We advise at all stages of Revenue civil and criminal prosecutions including representation at Appeal Commissioner, District, Circuit, High Court and Court of Appeal level, and also in negotiating settlements with Revenue.  We also have experience in cross-border Revenue proceedings (both civil and criminal).
