Marie-Alice is a general commercial litigator with a particular focus on regulatory investigations, contentious competition matters, corporate and M&A disputes, mis-selling claims, and regulatory work. 

Key highlights include advising:

  • Commission for Communications Regulation: in relation to its investigation and finding of non-compliance against Virgin Media and its subsequent successful Commercial Court proceedings seeking a declaration that Virgin Media had not complied with its obligations under Regulations 25(6)(b) of the Universal Service Regulations, being that “…the undertaking shall ensure that conditions and procedures for contract termination do not act as a disincentive to a consumer to changing service provider” together with an order directing that Virgin Media comply with its obligations.
  • A Financial Institution: in an investigation by the CBI into a suspected prescribed contravention under the EMIR Regulations.
  • DAF Trucks: in its defence of over 60 follow-on damages actions in Ireland, being the largest competition law damages action to date, arising from a Commission decision which determined there had been an infringement by truck manufacturers of EU competition rules.
  • A Medical Device Manufacturer: in its defence and resolution of proceedings alleging abuse of a dominant position arising from an alleged refusal to supply.
  • Various entities: in their defence of CCPC and European Commission investigations in relation to suspected infringements of competition law, to include advising in relation to unannounced inspections by the authorities.
  • Sellers of Barracuda FX:  Acting for the Sellers in Commercial Court proceedings to recover deferred consideration due under a SPA.
  • A Financial institution: in its defence of 22 mis-selling claims arising from investments in geared property funds.
  • Sea-Fisheries Protection Authority: in its successful defence of High Court judicial review proceedings arising from the exercise by the SFPA of its control powers and in which the Court of Appeal have made a preliminary reference to the Court of Justice of the European Union.
